We have built up a wealth of legal experience dealing with issues that arise in the construction and engineering industries.

We have dealt with issues arising out of office developments, industrial units, retail centres, hospitals, schools and colleges, airports, power plants, chemical processing and infrastructure projects. The following are typical of the matters we have successfully handled:

Claim for in excess of £5million by a main contractor against the employer on the final account
Defending substantial claims for loss and expense and extension of time from sub-contractors
Securing substantial extensions of time for contractors and sub-contractors

Arbitration

We have considerable experience of representing parties in arbitration proceedings. Recent experience has included representing a main contractor (in a successful defence of a claim by a sub-contractor) in a multi-party arbitration.

International Arbitration

In terms of International Arbitration, our experience has included a complex petrochemical ICC arbitration involving issues of foreign law and claims preparation, and large infrastructure projects in the Far East.

Technology and Construction Court

We have extensive experience of bringing and defending claims in the Technology and Construction Court. We have been involved in numerous reported cases including:

The Striking out of a claim by a sub-contractor against a contractor over mechanical works.
A claim involving a declaration that a sub-contractor’s cap on liability was incorporated into a sub-contract; and
The striking out of an adjudicator’s decision which was declared out of time.

Mediation

With our assistance and advice, our clients have had some incredibly positive results in mediation. The mediations have dealt with matters that range from simple payment issues, through to finding a solution to a claim between a design and build contractor and an Architect over numerous design defects.

ICE Conciliation

Resolving a multi-million pound claim between main contractor and employer.

Contract Advice

Preparing and advising on contracts and related documents for various projects including factories, sports stadia, retail and mixed use developments, office parks, hospitals, supermarkets and process plants.

PFI

Advising the main contractor on an ISTC project and negotiating the bespoke form of building contract which stepped down the provision of the PFI Project Agreement.
